According to The Times, a leaked copy of the Equality and Human Rights Commission’s guidance proposes the potential exclusion of transgender individuals from gender-specific spaces based on their appearance.
Nearly three months after the document was sent to ministers, Mr. MacAlister highlighted the need for a thorough assessment due to the significant implications on physical infrastructure and the potential for staff to make subjective judgments.
Elsewhere, Women and Equalities Minister Bridget Phillipson expressed a cautious approach in reviewing the watchdog’s guidance, which had prompted a call for swift action from the EHRC.
The existing code, last updated in 2011, has undergone revision following a Supreme Court ruling in April clarifying the definition of “woman” and “sex” in the Equality Act 2010.
In response to queries about the code, Ms. Phillipson emphasized the importance of ensuring proper implementation, especially in critical services like domestic violence shelters and rape crisis centers, while also underscoring the significance of treating transgender individuals with dignity and respect.
