Trump Commutes Fraudster’s Sentence Early

Donald Trump has caused outrage by releasing another convicted billionaire fraudster. The president intervened just 12 days into David Gentile’s prison term to commute his seven-year sentence. Gentile, who defrauded investors of £1.21 billion, was released abruptly last week, shortly after reporting to prison on 14 November, according to Bureau of Prisons records.

Gentile and his associate, Jeffry Schneider, were found guilty in August 2024 of securities and wire fraud. They deceived over 17,000 investors with false promises of guaranteed returns from private equity funds operated by their company, GPB Capital.

While a federal judge sentenced Gentile to seven years in prison in May, Schneider received a six-year term. Trump’s commutation does not erase Gentile’s conviction or eliminate potential penalties related to the case. Schneider, who remains in prison, has not received any clemency.

The White House confirmed Trump’s Thanksgiving-week action, which was initially praised on social media by Alice Marie Johnson, known as Trump’s “pardon czar.” Johnson, who was granted clemency by Trump and advises on pardons, expressed gratitude for Gentile being reunited with his children.

Trump has previously used his clemency powers to nullify white-collar convictions and criticize prosecutions he views as politically biased. Despite prosecutors describing the misconduct at GPB Capital as a clear and damaging fraud, Trump has pardoned numerous individuals who were convicted and owed billions of dollars to the government.

Investors were lured with promises of an eight percent annual return from profits of portfolio companies like car dealerships, but instead, a significant portion of the funds came from new investor contributions, creating a false impression of profitability.

The US Attorney for the Eastern District of New York, Joseph Nocella Jr., stated, “They raised approximately $£1.6 billion from individual investors based on false promises of generating investment returns from the profits of portfolio companies, all while using investor capital to pay distributions and create a false appearance of success.”

Over 1,000 victim statements submitted to the court highlighted the human toll, with some individuals losing their life savings and struggling to make ends meet. Adam Gana, a lawyer representing defrauded investors, condemned Trump’s intervention, asserting that Gentile should remain in prison given the heartbreaking stories heard.

Gentile, a Scientologist and former CEO of GPB Capital, spent just 12 days behind bars before Trump’s decision freed him. The White House indicated that the firm had disclosed in 2015 that investor capital could fund distributions, arguing against categorizing the case as a Ponzi scheme.

Gentile’s defense attorneys and representatives for Schneider declined to comment, and Gentile did not respond to requests for a statement. Trump’s commutation is part of a pattern where he exercises broad clemency powers, prompting accusations of favoritism and cronyism.

The Department of Justice has not imposed a restitution order in the criminal case, although victims are pursuing compensation through civil litigation. As Gentile walks free, Schneider remains incarcerated, serving his six-year sentence without similar clemency from the president.

In a separate case, Changpeng Zhao, the founder of Binance, the world’s largest cryptocurrency exchange, was pardoned by Trump in October. Zhao, also known as “CZ,” was sentenced to four months in prison for violating US money laundering laws. Binance pleaded guilty and was fined £3.4 billion for assisting users in evading sanctions.

Additionally, Trump commuted the sentence of George Santos, a former Republican congressman serving time for fraud and identity theft. Trump’s decision to release Santos sparked controversy as it raised questions about the White House’s stance on cryptocurrency, given the Trump family’s growing investments in the sector.
